Send13 operates two distinct data relationships: as a data controller for the personal information of our own customers (the senders who use our platform), and as a data processor for the subscriber lists those customers upload, send to, and manage through Send13.

We collect information you voluntarily provide when you:

- Business Information: Company name, website URL, role, industry

- Payment Information: Billing details (processed securely through our payment processor — we do not store full card numbers)

Subscriber Data Processed on Behalf of Customers
When Send13 customers upload subscriber lists, send email campaigns, or operate autoresponders through our platform, we process the resulting subscriber data as a data processor under our customers' data controller relationships with their own subscribers. Our handling of this data is governed by our Terms of Service and any applicable data processing addenda.
Subscriber data we process on behalf of customers may include:
- Subscriber email addresses, names, and optional metadata uploaded by the customer
- Engagement events (opens, clicks, bounces, complaints, unsubscribes)
- Send timestamps, campaign metadata, and routing decisions
- Inbound replies routed to the customer's reply address through our reply engine
- Suppression and unsubscribe records
Hashing by design. When subscriber engagement events flow through our VIP13 engagement intelligence layer, recipient identifiers are hashed using SHA3-256 before scoring storage. Plaintext email addresses are not retained in the scoring layer. Customers retain full control over their subscriber lists in the sending platform.
How We Use Your Information
We use the information we collect to:
- Provide and operate the Send13 email marketing platform
- Deliver email campaigns through our sending infrastructure and partner ESPs
- Process inbound replies and route them to your reply address
- Compute engagement classifications and deliverability scoring
- Authenticate API requests, enforce sending limits, and protect platform reputation
- Process payments and send transaction confirmations
- Communicate service updates, changes, and security notices
- Respond to your inquiries and provide customer support
- Detect, investigate, and prevent fraud, abuse, deliverability harm, and security incidents
- Comply with legal obligations
Email Communications
We send email communications for:
- Account confirmations and security notices
- Service updates, downtime notifications, and changelog summaries
- Payment receipts and billing notices
- Deliverability alerts and reputation notices
- Responses to your inquiries
You may unsubscribe from non-essential emails by clicking the unsubscribe link in any email or contacting us directly. Operational and security communications cannot be unsubscribed from while your account is active.

- Sending Service Providers: Email service providers (such as Amazon SES, Mailgun, SendGrid, and KumoMTA-based relays) and third-party MTAs that deliver email on your behalf at your direction. These providers process subscriber data only to deliver the campaigns you initiate.
- Other Service Providers: Cloud hosting, payment processing, analytics, customer support, and infrastructure vendors. These providers are contractually obligated to protect your information and use it only for the purposes we specify.
- Affiliates: Other companies within the Send13, LLC family of products (including VIP13 and Klean13), where doing so is necessary to provide the services you've requested.
- Affiliate Networks and Offer Partners: Where you operate as an affiliate marketer through our platform, click-tracking and conversion data is shared with the affiliate networks and offer partners you've selected, in accordance with your campaign configuration.
- Legal Requirements: When required by law, court order, subpoena, or governmental authority, or to protect our rights, property, or safety, or that of others.
- Business Transfers: In connection with a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction.
Data Security
We implement appropriate technical and organizational measures to protect personal information, including:
- TLS encryption in transit for all API, dashboard, and inbound email traffic
- SHA3-256 hashing of recipient identifiers at the engagement intelligence layer
- Access controls, authentication, and audit logging
- Network isolation between sending infrastructure, scoring, and public-facing services
- Routine review of dependencies, secrets, and infrastructure
- Encrypted backups with periodic restore testing
While we strive to protect your information, no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security.
Data Retention
We retain personal information for as long as necessary to:
- Provide our services and maintain your account
- Maintain sending history, suppression lists, and compliance records required for email deliverability and CAN-SPAM, GDPR, and CASL compliance
- Compute and serve engagement classifications over rolling time windows
- Comply with legal, accounting, and reporting obligations
- Resolve disputes and enforce our agreements
Upon account termination, customer-uploaded subscriber lists are deleted in accordance with our data retention policy and any applicable data processing addenda. Suppression records and bounce/complaint history may be retained as required to comply with anti-spam law and to protect platform deliverability.
International Data Transfers
Send13 operates infrastructure primarily in the United States. If you access our services from outside the United States, your information may be transferred to, stored, and processed in the United States. Where required by law, we rely on appropriate safeguards such as Standard Contractual Clauses for international transfers of personal data.

Depending on your location, you may have the right to:
